Terms of Service

1. Acceptance of Terms
By accessing or using AccuracySuite ("the Service"), operated by Aerial Sensing ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
AccuracySuite provides advisory positional accuracy computations aligned to ASPRS Positional Accuracy Standards for Digital Geospatial Data, Edition 2. The Service includes:
- Checkpoint data upload and parsing
- RMSE, CE90, LE90, NVA, and accuracy class computation
- ASPRS Edition 2 statement language generation (Tested/Produced to meet)
- Branded PDF report generation (email opt-in required)
- GCP/checkpoint network planning recommendations
- Anonymized accuracy benchmark (opt-in)
3. Not a Certification
Critical Disclaimer
AccuracySuite is NOT a certification, NOT a licensed land survey, and NOT a substitute for a surveyor's stamp or professional certification. Results are advisory computations aligned to a published standard. The operator, surveyor, or responsible professional retains full professional responsibility for all survey and mapping deliverables. Where legally required, seek sign-off from a licensed professional surveyor.
4. User Responsibilities
- You are responsible for the accuracy and completeness of data you upload.
- You must select the correct CRS (EPSG), units, and vertical datum for your data.
- You must not use the Service for any unlawful purpose.
- You must not upload data containing personally identifiable information of third parties without consent.
- You acknowledge that results depend entirely on the data you supply.
5. Free Tier & Paid Features
On-screen accuracy results (statistics, class statement, charts, residual table) are always free and ungated. PDF report generation, benchmark percentile, and saved report management require an email opt-in. No credit card is required.
6. Intellectual Property
The Service, including its ASPRS classification module, formula implementations, templates, and branding, is the intellectual property of Aerial Sensing. You retain all rights to your uploaded data and generated reports. Reports may be freely shared, distributed, or attached to client deliverables.
7. Limitation of Liability
To the maximum extent permitted by law, Aerial Sensing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages arising from incorrect accuracy assessments, CRS/unit selection errors, or reliance on computed results. Our total liability shall not exceed the amount you paid for the Service (if any) in the 12 months preceding the claim.
8. Data Retention
Uploaded checkpoint data is retained for 90 days to enable report regeneration. After 90 days, raw data is automatically deleted. Generated PDF reports and share links are retained for 30 days unless you have an active account. Anonymized benchmark contributions are retained indefinitely (no PII stored).
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications to the Service at any time. We are not liable for any loss resulting from service unavailability.
10. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service. Continued use after changes constitutes acceptance of the modified Terms.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.
